Man will serve prison time after breaking probation

A Green River man who failed to register as a sex offender pleaded guilty to two felony counts.

Colton S. Martinez, 27, recently appeared in the Third District Court of Judge Richard Lavery for a change of plea and sentencing hearing to three felony counts of failure to register and one misdemeanor charge of prohibited access to school facilities by adult sex offender.

In exchange for Martinez’ guilty plea to two felony counts of failure to register, one count of failure to register and the misdemeanor charge of prohibited access to school facilities by adult sex offender were dismissed. He was given two five to 10-year prison sentences.

Both terms were suspended and he was placed on three years supervised probation, which will run consecutive with another case.

According to court documents, on Feb. 25, 2014, Martinez was convicted of first-degree sexual assault and was required to register as a sex offender.

He is also required to report in person his current residence every three months and any new place of employment within three days. For one of the failures to report, Martinez failed to report a change of address. This charge was dismissed.

For the misdemeanor charge he failed to report that his new address was within .1 miles of Truman Elementary School. This charge was also dismissed.

He also failed to report a change of employment when he started a new job at a local construction company. He then failed to report a loss of employment when he no longer was employed at the construction company.

These two felonies were the ones Martinez pleaded guilty to.

Due to the probation violation on the previous charge of first-degree sexual assault, Martinez will serve 18 months to 36 months in the Wyoming Department of Corrections. After his sentence is over, he must check in at probation and parole in Green River.

One of the stipulations in his new probation terms is Martinez cannot move, change his address or quit his job without the prior permission of his probation agent.

He must also keep the agent advised of his whereabouts at all times upon his release from prison.
