Man sentenced for felony assault

A Green River man who admitted to trying to strangle his girlfriend and hurting his daughter’s wrist will serve time in prison.

Jason Lane Kirby recently appeared in the Third District Court of Judge Nena James at a change of plea and sentencing hearing to strangulation of a household member and child abuse and two misdemeanor charges of interference with a peace officer and interference with emergency calls.

Kirby pleaded no contest to a felony charge of strangulation of a household member and a misdemeanor charge interference with a peace officer. The felony child abuse and misdemeanor interference with emergency call charges were dismissed.

Pursuant to a plea agreement, Kirby was given a one-and-a-half-year to three-year prison sentence to be served in the Wyoming Department of Corrections, with credit given for 74 days served.

According to court documents, on Dec. 25, 2013, Green River officers responded to a domestic abuse call on Riverview.

Upon arrival, officers spoke to Kirby’s girlfriend who said she and Kirby had lived together for 15 years and have three children together.

She told officers she and Kirby had gotten into an argument that wouldn’t end so she was going to call the police. Kirby grabbed her and attempted to take the phone away. During the struggle, the phone fell to the floor.

His girlfriend said Kirby at some point grabbed her around the neck with both hands and began to strangle her.

At this point, their teenage daughter entered the room and grabbed the cell phone to keep it away from Kirby. Kirby grabbed the girl’s arm and twisted the phone out of her hand. He then left the house.

Officers requested an ambulance. Officer observed red marks on the girlfriend’s neck. EMS personal told her that her daughter’s wrist needed to be looked at by a doctor, but the two refused to be taken to the hospital. The daughter was taken to the hospital later and was diagnosed with a sprained wrist.

When Kirby returned home, officers were on scene to arrest him. When officers told Kirby he was under arrest, Kirby ran away.

An officer caught Kirby, forced him to the ground, where Kirby continued to resist arrest.
