Local man charged with aggravated assault

A Green River man has been charged with aggravated assault and battery following an alleged incident Nov. 2.

Brian Setzer, 32, was arrested after the Green River Police Department was called to Memorial Hospital of Sweetwater County to investigate a third-party report of domestic violence.

According to court documents, upon her arrival, Green River Police Officer Shantell Erickson was advised by an emergency room nurse that Ashley Rillamas had been brought into by her fiancée Setzer after the two had been in an altercation.

The nurse stated that she had been struck in the eye by a baby gate that had been thrown at her by Setzer.

The nurse told the officer that Rillamas had a significant injury to her left eye that may require emergency surgery.

Officer Erickson was advised that after a CT scan, Rillamas had to be flown to Salt Lake City for surgery.

Documents state Erickson met with Rillamas at the hospital and observed that she had sustained an injury to her left eye that was completely swollen shut and had dark purple bruising. Erickson noted that Rillamas had difficulty speaking because she was in a lot of pain and had received medication for her comfort.

Erickson than responded to an address in Green River to speak with Setzer who said he and Rillamas had been together since 2007 and have a son together.

In the affidavit, Erickson said he and his fiancée had been “goofing around” at first, but then the situation escalated when Rillamas started “pushing his buttons.” Setzer explained to the officer that he suffers from OCD and gets angry easy. The documents state Setzer told the officer that he put the baby gate high on the wall so that Rillamas could not get over it.

He than told the officer that as Rillamas came up the stairs towards him, that he kicked the baby gate toward her, and he was angry when he did this. He told Erickson he had his shoes on and kicked the gate in a “hooking” manner which broke it and caused the gate to strike her in the face.

He stated he took her to the emergency room when he realized she had sustained significant injuries.

Setzer is currently incarcerated at the Sweetwater County Jail.Aggravated assault and battery is a felony punishable by no more than 10 years in prison and a fine to not exceed $10,000 or both.
